Note:  This calendar has been developed with compliance deadlines from selected Federal and state legislation in mind and does not reflect all laws, jurisdictions, facilities, situations and circumstances.  Please feel free to submit deadlines (even local) for future calendars to webmaster@vanguardenvl.com.  Federal EPA, OSHA, DOT Compliance Deadlines are listed by monthly calendar, while state-specific compliance deadlines are listed under each state’s heading.

Important Enforcement Note
:
Many OSHA Compliance Deadlines are recognized as that day selected by an OSHA inspector for facility visitation with the expectation that compliance requirements have been satisfied.  Most OSHA inspectors consider a company’s compliance obsolete if its representative defensible documentation appears to be more than one year old.  Vanguard, therefore, recommends that Sr. Management in any company proactively self-imposes annual deadlines for compliance programs required by OSHA, DOT, or other regulatory agencies to be updated on an annual basis.  The majority of these compliance mandates are training-intensive relative to employees and supervisors.  The point is well taken that the EHS Manager is severely burdened with environmental issues and deadlines in the first six months of every year.  Moreover, the summer months are filled with personnel vacations and residential moving, rendering employee training vulnerable to spotty attendance.  Hence, compliance modules appear on the following calendar from September through December for this purpose, knowing that employee vacations and the like will have been taken, most residential moving has transpired, and a company’s workplace will probably experience its highest level of employee attendance from September through the end of the year.

Suppliers / Product originators and mfrs. must give notification to each recipient of mixtures or trade name products containing listed toxic chemical with first shipment of the calendar year.

Exporters of certain toxic chemicals regulated under Sections 4 & 5(b) must give notice to EPA with the first export of the calendar year.
*OSHA: AIR CONTAMINANT EXPOSURE LIMITS

Compliance with certain permissible exposure limits (pels) applicable to grain-handling industries in SIC Codes 0723, 2041, 2044, 2046-8, 2075, 4221, & 5153 may no longer be achieved through use of the methods specified in a Dec. 24, 1990 OSHA interpretation.  See amendments under 29 CFR 1910.1000.

January 6

*EPA: RCRA HAZARDOUS WASTE
Final rule is effective this date for fluorescent lamps which has been added to universal waste list.  Defines lamp as the bulb or tube portion of an electric lighting device, covers fluorescent, high-intensity discharge, neon, mercury vapor, high-pressure sodium, and metal halide lamps.  All lamps not recycled will continue to be treated with the same disposal safeguards that apply to all hazardous wastes

*MDEQ: ANNUAL WASTEWATER REPORT
First Michigan Wastewater Report due by 2002.  This is an amendment to Section 3111 of the NREPA, 1994 PA 451.  Requires all persons doing business within Michigan who discharges to the waters of the state or to any sewer system wastewater that contains wastes in addition to sanitary sewage to file an annual report on a form provided by the state.

Review all programs conducted for employee training and survey all records to make sure all files are complete, well organized, and readily accessible in the event of OSHA inspection.  Alert at least two Sr. Mgrs. as to location of all records in case of EHS Mgr’s absence during an announced inspection.  Make preparations for new Ergonomics Standard and Injury & Illness Prevention Program (IIPP) Standard.
