RATIONALE: DUE DILIGENCE & THE REGULATORY COMPLIANCE AGENDA

             American Business & Industry has been impacted with the critical challenge of satisfying an extensive scope of regulatory compliance requirements.  The problem is compounded by ever-evolving laws from three independent departments of the Federal Government, as well as those regulatory offshoots at state, county, and local jurisdictions. Federally, there are some 40 regulatory laws, compounded in California by 20 other related laws, and then administered at the local agency level in most cases. 

            Vanguard takes a common sense, but serious approach to Environmental Compliance Management.  It's only sensible that industry must approach regulatory compliance with an emphasis on due diligence for all compliance laws which, in turn, must lead to a site-specific "Regulatory Compliance Agenda."  A company must know which laws require compliance and which do not.  It must know its "Regulatory Compliance Agenda" for each and every compliance year, as well as the dynamic changes due to amended and newly-enacted laws.  The stakes are too high to do otherwise when considering the repercussions of enforcement penalties for non-compliance on laws in which personnel aren't even aware of their existence, much less their compliance mandates.  Hence, Vanguard's mission is two-fold:

INTRODUCTION & RATIONALE 

The EHMMP is a state-of-the-art, internet-based MATERIALS MANAGEMENT program accessible by monthly subscription to Vanguard clients.  Its origin finds a foundation in a client’s desire to manage his product / chemical inventory daily through Vanguard's $10MM chemical technology - literally the third largest in the U.S. behind the EPA in Washington, D.C., and EPA’s government contractor assigned to selling EPA's myriad of chemical lists.  Of course, Vanguard's existing technology and service is designed with different end-result objectives in mind: to serve the client's compliance management needs with regard to, first, DETERMINING the "Regulatory Compliance Agenda" unique to the client's site-specific federal, state, county, and local requirements impacting the client’s facility; and, second, to IMPLEMENT the appropriate due diligence, task orientation, and development of defensible documentation on a Turn-Key basis necessary for satisfying the client's compliance mandates.  The essence of the EHMMP is the improved capability for Vanguard's client to track and control those hazardous materials on site to, in turn, effectively and efficiently facilitate a 365-day-a-year Environmental, Health, & Safety (EHS) Program so vitally protective of employees, contract labor, the environment (air, land, water), the community-at-large, and the region downwind from the facility.

MSDS MASTERMIND (MSDSM)
"A Paperless System for MSDS Compliance"
FEATURING THE ENHANCED TECHNOLOGY
 OF THE ELECTRONIC HAZMAT MANAGEMENT PROGRAM

INTRODUCTION & RATIONALE
In 1994, OSHA modified its Hazard Communication Standard under 29 CFR 1910.1200 to include paperless systems for MSDS compliance management responsibilities. Regardless of how MSDSs are maintained, the law requires that employers make Material Safety Data Sheets readily accessible to employees at all times on hazardous chemicals used, stored, processed, produced in the workplace. Vanguard is pleased to offer this paperless system for site-specific  MSDS Compliance to clients who wish to operate thru electronic technology and computers via the internet as opposed to the traditional approach of hard-copy MSDS inventory management. Vanguard's MSDSM goes hand-in-hand with the Electronic Hazardous Materials Management Program (EHMMP) as described below for the purpose of ongoing electronic MSDS inventory management. The dualistic operation of both programs allows the client to continually update and apprise Vanguard's "mission control" of additions and deletions to the facility's MSDS inventory, modifications in product quantity, container types, product locations within the facility, and even physical changes to the facility itself.

MONTHLY SAFETY MEETINGS FOR EHS MANAGERS

ETTCP helps upscale organizations with large, diverse workforces overcome the administrative nightmares associated with the tracking, planning, & monitoring of ongoing employee training requirements imposed upon industry by EPA, OSHA, DOT, MSHA, & other federal agencies, as well as state, county, & local regulations. ETTCP combines strategic planning applications of the RCA with the power tool to effectively administer the organization’s employee training program, even balancing the dynamics of new-hires coming & going. A relational database first defines site-specific EHS compliance issues triggering employee training requirements, after which the training/tracking technology is strictly customized to fit the specific needs & issues unique to the organization. Nothing is generic! The end result is accurate, efficient tracking, all the way to implementation of employee training scheduled throughout each regulatory year. ELECTRONIC HAZARDOUS WASTE REPORTING (EHWR)

EHWR places all aspects of hazardous waste reporting on auto-pilot relative to the generation, accumulation, storage, manifesting, disposal, & subsequent electronic report filing of hazardous waste to agencies with jurisdiction over your facility. All systems and client data are secure. Over 640 hazardous waste codes are analyzed through Vanguard’s RCA above. When the RCA is already being done, the setup fee is waived. EHWR requires a nominal monthly fee.

AIR EMISSIONS PRODUCT INVENTORY TRACKING (AEPIT)

AEPIT establishes an accurate emissions tracking system for your facility on a turnkey basis, strictly aligned with regulations affecting your facility. Based on local & state laws, emissions tracking may entail daily, weekly, monthly, or annual air emissions tracking requirements. All systems & client data are secure. An analysis of all chemicals, usages, point sources, & air permit conditions is accomplished thru Vanguard’s RCA program above. When the RCA is already being done, the setup fee is waived. AEPIT, including Emissions Inventory Reporting, when mandated, requires a moderately-priced monthly fee. Air permitting, if desired, is a separate engineering project &, therefore, would require a different scope of work & fee arrangement.

FORM R PRODUCT INVENTORY TRACKING (FRPIT)

With over 700 toxic chemicals now listed for Form R Reporting, aka Toxic Release Inventory (Canadian counterpart: NPRI), product tracking for annual usages is an administrative nightmare. FRPIT cuts the job down to size with monthly tracking. This includes the oft-neglected aggregate total ruling, plus the upcoming changes to threshold applicability begun with compliance year 2000 as required by the U.S. EPA. In addition to product inventory tracking, Vanguard’s engineering department performs the essential chemical mass balance calculations to submit applicable reports to federal & state agencies. All systems & client data are secure. An analysis for all toxic chemical candidates specific to your site is accomplished thru Vanguard’s RCA above. When the RCA is already being done, the setup fee is waived. FRPIT, including state & federal Form R Reporting as mandated, requires a moderately-priced monthly fee.

ELECTRONIC DISCHARGE MONITORING REPORT (EDMR)

EDMR is an industrial strength program that tracks the toxic pollutants related to process / waste water discharge under the Clean Water Act, as well as the 273 water priority chemicals for EPA’s Storm Water Runoff Program, both administered by state & local agencies. EDMR places your company on a regularly scheduled program of discharge monitoring, thus ensuring precision tracking/reporting of site-specific regulations governing your facility. All systems & client data are secure. An analysis for all pollutants is done through Vanguard’s RCA above. When the RCA is already being done, the setup fee is waived. FRPIT, including report filing as mandated, requires a moderately-priced monthly fee.
